Tesla Faces Major Trial Over Alleged Racial Bias Against Black Workers
Tesla has entered a major legal battle in California over allegations of racial discrimination at its Fremont factory. The California Civil Rights Department (CRD) filed the lawsuit in 2022 after an investigation into workplace practices at Tesla.
The agency alleges that Black workers faced racial harassment, unequal pay and fewer opportunities for promotion. Tesla has denied wrongdoing and says it does not tolerate workplace discrimination.
The latest trial began on September 21, 2026, and Judge Peter Borkon will hear the case without a jury.
What Are the Allegations Against Tesla?
The California Civil Rights Department alleges that Black employees at Tesla’s Fremont factory faced repeated racial slurs and racist graffiti. The agency also claims that Tesla failed to properly prevent or address complaints about the alleged conduct.
The lawsuit goes beyond workplace harassment. CRD alleges that Black workers often received lower-paying and less desirable jobs and faced fewer opportunities for promotions. The agency also claims that Black employees received lower average compensation than white workers during the period covered by its analysis.
According to CRD, an analysis of employee pay from June 2018 through June 2024 showed that Black workers received an average of $1,533 less in monthly compensation than white workers. The agency has presented this figure as part of its broader pay discrimination allegations.
Tesla’s Response and Trial Details
Tesla and its lawyers did not respond to Reuters’ latest requests for comment. However, the company has previously denied the allegations and said it does not tolerate discrimination. Tesla has also said that it has taken action against employees involved in workplace misconduct.
Judge Peter Borkon will decide the case in a bench trial rather than a jury trial. Reuters reports that the proceedings could continue until October 30, 2026. California law does not place a federal-style cap on damages for workplace discrimination claims, so the case could carry significant financial consequences if the court finds Tesla liable.
Other Race Discrimination Cases Against Tesla
The Fremont case forms part of a wider series of legal claims involving Tesla. The company also faces a lawsuit from the U.S. Equal Employment Opportunity Commission and individual lawsuits from workers making similar allegations.
In a separate case, a California judge ruled in 2025 that more than 6,000 Black Tesla workers could not continue their claims as one class action. The ruling did not end other individual or separate legal claims against the company.
